Release of Liability Waiver
Participant Enrollment
I, the "releasee," Name Here, acknowledge that I am enrolling my child/children/family member(s) or other participants in the private lacrosse training program offered by Sagebrush Lacrosse LLC. I understand that participation involves inherent risks, including but not limited to injury, illness, infection (e.g., MRSA, influenza, COVID-19), slips and falls, equipment malfunction or failure, physical contact with other participants, weather-related hazards, and emotional distress. I am aware that these risks may result in serious consequences, such as permanent disability or even death. By enrolling in this program, I acknowledge my understanding of these potential risks and accept them on behalf of the participant(s).
Waiver Agreement
I, the releasee, along with any parents or adults I am associated with who are participating in the Sagebrush Lacrosse LLC lacrosse training program, agree to hold harmless Sagebrush Lacrosse LLC, its owners, Lacrosse Trainers, agents, employees, successors, and assigns for any injuries, damages, or losses that may occur due to their participation, to the extent permitted by law. This agreement does not waive the rights of any child or minor to pursue legal action in the event of negligence or fault by Sagebrush Lacrosse LLC or its associates.
Risk Acknowledgment
I acknowledge, agree, and understand that there are inherent risks associated with the sports activities/lacrosse training conducted by Sagebrush Lacrosse LLC, including, but not limited to, severe injuries, and even death. These activities could be hazardous in nature and encompass various forms of strenuous exercise and physical activities. Fully comprehending the facts, I declare that, to the best of my knowledge, the students enrolled have no medical, physical, or emotional health conditions that would obstruct or hinder their participation in Sagebrush Lacrosse LLC programs. I hereby willingly assume the risk of any injury to the registered students that could arise from their involvement in Sagebrush Lacrosse LLC activities.
Lacrosse Field, Training Location, Facility, Equipment and Behavior Control Disclaimer
Sagebrush Lacrosse LLC is not responsible for inspecting or maintaining facilities used for lacrosse training, as these may be owned or operated by third parties. Sagebrush Lacrosse LLC also does not assume responsibility for providing or maintaining any equipment utilized during training. Clients are responsible for ensuring that facilities and equipment meet safety standards and are appropriate for lacrosse training.
Additionally, Sagebrush Lacrosse LLC does not have control over the behavior of clients or Lacrosse Trainers during training. Clients are expected to adhere to the rules and guidelines established by Sagebrush Lacrosse LLC and to maintain a respectful and safe environment for all participants.
By registering scheduling a lesson with Sagebrush Lacrosse LLC, I, the releasee, acknowledge and agree to these conditions and release Sagebrush Lacrosse LLC from any liability for injury, death, or property damage suffered by me, my child/children/family member(s), or other registered students/participant’s that may arise from facility or equipment conditions, or client or Lacrosse Trainer behavior.
Prohibition of Physical Aggressiveness and Assumption of Risk
Sagebrush Lacrosse LLC (“the Company”) is steadfast in its commitment to promoting a safe and constructive environment during lacrosse training sessions. Accordingly, all participants are expressly prohibited from engaging in any form of aggressive physical contact, including but not limited to checking, stick checking, body checking, or any other aggressive physical actions toward other participants, coaches/trainers or staff.
Participants are required to exhibit sportsmanship and respect toward fellow participants, coaches, and staff. Any behavior or action that compromises the safety or positive experience of others is strictly prohibited and may result in immediate expulsion from the training session.
By participating in Sagebrush Lacrosse LLC’s lacrosse training program, participants acknowledge and willingly assume the risks associated with the sport of lacrosse. Participants further agree to abide by these guidelines and understand that failure to comply may result in termination from the training program without a refund.
The participant, or the parent/guardian if the participant is a minor, hereby releases, holds harmless, and indemnifies Sagebrush Lacrosse LLC, its owners, agents, representatives, and employees from any and all claims, demands, losses, causes of action, lawsuits, judgments, including attorneys’ fees and costs, to the extent allowed by law, protected against any liability for any and all personal injury, sickness, or accident, loss or injury to personal property, or any other foreseeable or unforeseeable event or outcome directly or indirectly arising out of, contributed to by, or resulting from any attempt by the participant to engage in prohibited physical aggressiveness, except in the case of gross negligence or willful misconduct on the part of Sagebrush Lacrosse LLC.
It is understood and agreed that this waiver, release, and assumption of risks is binding on the participant and their heirs, executors, administrators, and assigns.
Weather-Related Rescheduling Responsibility Clause
Sagebrush Lacrosse LLC is dedicated to ensuring the safety of all participants and Lacrosse Trainers during lacrosse training. In the event of inclement or life-threatening weather conditions, such as thunderstorms, lightning, heavy rain, hail, extreme heat, or other hazardous situations, it is the responsibility of the releasee, parents, or guardians to reschedule the lacrosse training in consultation with Sagebrush Lacrosse LLC's Lacrosse Trainers. Sagebrush Lacrosse LLC's Lacrosse Trainers will also provide input and guidance on rescheduling training to ensure the well-being of all involved. By enrolling in the lacrosse training program, the releasee, parents, or guardians acknowledge and accept that training may be subject to postponement, cancellation, or relocation due to weather conditions.
Responsibility Acceptance
I agree to accept full responsibility for any injury, illness, disability, or loss experienced by the participant(s) I register during attendance at the Sagebrush Lacrosse LLC lacrosse lesson program. I understand that this agreement does not waive a participant who is considered a child or minor’s rights to seek legal remedies, but I do release Sagebrush Lacrosse, its employees, agents, and representatives from all related claims, liabilities, actions, damages, costs, or expenses, to the extent permitted by law.
Safety Responsibility
I acknowledge that Sagebrush Lacrosse LLC's private lacrosse training program is not a substitute for supervision or safety measures, and I am responsible for ensuring proper supervision and safety measures for my child/children/family member(s) or participants I sign up in my registration form when participating in lacrosse activities.
Risk Acceptance
I, the releasee, understand the risks involved in this lacrosse training program, my personal responsibilities for adhering to rules and regulations, and accept them as a participant in Sagebrush Lacrosse LLC's lacrosse training program.
Liability Release
I release Sagebrush Lacrosse LLC, its owners, operators, trainers, and field hosts from liability for any loss, damage, injury, or death that may be sustained by myself, my child/children/family member(s), or any registered student on the premises or under Sagebrush Lacrosse's control and supervision, except in cases where such loss, damage, injury, or death is caused by the negligence or fault of Sagebrush Lacrosse LLC or its associates. This release does not waive the rights of any child or minor to pursue legal action in the event of negligence or fault by Sagebrush Lacrosse LLC or its associates.
Photo and Video Release
I understand that Sagebrush Lacrosse, their lacrosse trainers or staff, may ask to take photos or videos during lacrosse lessons for promotional & educational purposes. Only under my written or verbal consent will I grant Sagebrush Lacrosse, their lacrosse trainers or staff, the right to use the participant's likeness in such material and publish or share these photos and videos on their social media pages, website, or other platforms. I am aware that I can decline or withdraw this consent at any time, and Sagebrush Lacrosse will honor my decision.
Indemnification
The releasee, whether participating in the lacrosse lessons themselves, acting as a parent or guardian of a participant, or enrolling a family member or friend, agrees to indemnify, defend, and hold harmless Sagebrush Lacrosse, its owners, employees, instructors, agents, and representatives from any and all claims, demands, damages, losses, expenses, liabilities, and causes of action, including but not limited to attorney's fees and court costs, arising out of or relating to the releasee's or participant's participation in the lacrosse lessons, including any claims or actions based on negligence, breach of contract, or breach of any statutory or other duty of care, to the extent permitted by law. This indemnification shall survive the termination or expiration of this agreement.
Severability
If any provision or part of this liability waiver is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the other provisions or parts of this waiver. The remaining provisions or parts shall remain in full force and effect as if the invalid, illegal, or unenforceable provision or part was never included in this waiver. The parties agree to replace any invalid, illegal, or unenforceable provision with a valid, legal, and enforceable provision that achieves, to the greatest extent possible, the original purpose and intent of the invalid, illegal, or unenforceable provision.
Electronic Signature
Release Of Liability Waiver is an electronic contract that governs your use of and access to the Sagebrush Lacrosse LLC website and services. Upon agreeing to the Release Of Liability Waiver when completing the lacrosse training registration form, you acknowledge that you understand and agree to be legally bound by the Release Of Liability Waiver and the terms, conditions, and notices contained or referenced herein. By inputting your electronic signature (Your name), this will hold the same legal force and effect as a handwritten signature.
